In this data protection notice, we inform you about the handling of your personal data that we process as part of the application process and inform you about your rights in this regard.

What Personal Data Do We Collect and Where Does It Come From?

We process the following personal data as part of the application process:

  • Master data (such as first name, last name, name affixes, nationality, etc.)
  • Contact details (such as home address, (mobile) phone number, email address)
  • Work permit / residence title, if applicable
  • Qualification data, such as educational history, professional activities, appraisals, certificates, continuing education, and training courses
  • Special knowledge and skills, as far as relevant for the advertised position
  • If applicable, severely disabled status

Your personal data is generally collected directly from you as part of the recruitment process. We receive this data in particular from the application documents and during job interviews.

For What Purposes and on What Legal Basis Is Your Data Processed?

First and foremost, data processing serves the purpose of entering an employment relationship. The legal grounds for the aforementioned is § 26 GDPR. We process voluntary information as part of your application (e.g., application photo) on the basis of Art. 6 (1) a) GDPR.

If your application documents contain special categories of personal data, e.g., information about health, religious beliefs, or ethnic origin, we also justify the processing on Article 9 (2) b) GDPR due to our legal obligations as an employer and the associated protection of your fundamental rights.

We will only use your contact details to contact you and inform you about the progress of the application process. We use other information contained in the application documents solely to determine your suitability for the position to be filled.

How Long Will Your Data Be Stored?

Your personal data will be deleted as soon as they are no longer required to achieve the purpose for which they were collected. In the event of employment, we will include your application documents in your personnel file, insofar as these are necessary for the implementation of the employment relationship. After termination of the employment relationship, those personal data will continue to be stored that we are legally obligated to retain. This regularly results from the legal obligations to provide proof and to retain data. The storage periods are then up to ten years.

In the event of rejection, your application documents will be deleted no later than six months after completion of the application process.

Who Receives Your Data?

Within MetaSystems, only those persons (employees of the human resources department, representatives of the specialist department, regional management), who are involved in the decision about your employment will receive your personal data.

What Rights Can You Assert as Person Affected?

You have the rights from Art. 15 – 21 GDPR:

  • Right of access (Art. 15 GDPR)
  • Right of rectification (Art. 16 GDPR)
  • Right to erasure (Art. 17 GDPR)
  • Right to restriction of processing (Art. 18 GDPR)
  • Right to data portability (Art. 20 GDPR)
  • Right to object to processing (Art. 21 GDPR)

Right of Withdrawal

If we process your data based on a declaration of consent, you have the right to revoke this consent at any time with effect for the future. The lawfulness of the processing carried out on the basis of the consent until the revocation remains unaffected by the revocation.

Will Your Data Be Transferred to a Third Country?

Automatic data transfer to third countries does not take place.

In the case of applications in third countries, the data will only be transferred to the respective country.

Are You Obliged to Provide Your Data?

To be able to consider your application, we require from you those personal data that are necessary for the decision on entering into an employment relationship. The absence of relevant personal data in the application documents may result in non-inclusion in the allocation of the work/training/internship position.

To What Extent Do Automated Individual Case Decisions or Profiling Measures Take Place?

We do not use purely automated processing to arrive at a decision.
